Approve Grant of Wastewater Utility Easement and Reimbursement Fee Agreement Between the School Board of Hillsborough County and CDCT Gardens, LLC at Robles Elementary School

CDCT Gardens, LLC, a Florida limited liability corporation, is the developer of the Gardens Townhome, a project constructed to serve families of low to moderate income and located adjacent to Robles Elementary School.  The developer has requested the School Board of Hillsborough County, Florida grant the project a wastewater utility easement from their property across a portion of Robles' western boundary to connect into the City of Tampa's main wastewater facility.  The Gardens will pay a one-time easement fee of $5,000 and be responsible to reimburse the School Board for up to $1,500 in legal fees.  A tree would need to be removed in the easement area, but the developer will provide replacement trees and the district will be able to locate them where best suited to the campus.

The Wastewater Utility Easement and Reimbursement Fee Agreement have been reviewed by district real estate legal counsel as to form and sufficiency.

Approval of the Wastewater Utility Easement and Reimbursement Fee Agreement between the School Board of Hillsborough County and CDCT Gardens, LLC will not create any expenses for the School Board.  The Gardens will pay a one-time $5,000 easement fee and reimburse the district up to $1,500 in legal fees.
