Approve Conveyance of 5.8 +/- Acres to the City of Tampa for the Continuation of the West River Walk at Blake High, Stewart Middle and Just Elementary Schools and Approve a Partial Release of Certificate of Participation Funding 

EXECUTIVE SUMMARY
The City of Tampa has requested the assistance of the School Board of Hillsborough County, Florida, to continue the implementation and development of a trail project (West River Walk) along the Hillsborough River in Tampa.  As part of the original property exchange with the City of Tampa for the Blake High School campus, the School Board was required to provide pedestrian access to the waterfront, a portion of which is the proposed trail that runs along the perimeter of the Blake High, Stewart Middle and Just Elementary Schools and  a small portion of additional land from the School Board would allow the community an uninterrupted waterfront trail.  In an effort to minimize issues relative to liability, use and maintenance, conveying ownership of the 5.8 +/- acres to the City of Tampa would be the appropriate legal determination.  Deed restrictions have been included that will protect the integrity and safety of the students, faculty and campuses, some of which are environmental enforcements, no alcoholic beverages or advertising.  The School Board will retain an easement for ingress/egress, utilities and drainage across the proposed trail area.

The City of Tampa will reimburse the School Board for legal fees in an amount not to exceed $7,500 upon deed conveyance.

FINANCIAL IMPACT (Budgeted:  No)

Conveyance of the 5.8 +/- acres behind Blake High, Stewart Middle and Just Elementary Schools to the City of Tampa for the continuation of the West River Walk and approval of the Partial Release of Certificate of Participation will have no financial impact to the School Board of Hillsborough County.  The City of Tampa will reimburse the School Board in an amount not to exceed $7,500 for legal fees.
