By letter agreement dated January 5, 2001 between the School District and McAteer Groves, Inc. ("Toulon Homeowners Association, Inc.), the District agreed to grant a perpetual, non-exclusive easement for drainage, retention, detention and treatment of stormwater, or placement, excavation, re-excavation, filling, maintenance, replacement, removal, of a stormwater drainage system or swale over, under, and across 10 feet of the center line of the existing drainage. This easement also allows for the District and Toulon to work cooperatively in the future for the relocation of this easement in the event either party's development plans require such provision.
