Approve Right-of-Way Conveyance to Hillsborough County for Roadway Improvements at Hammond Elementary School

On September 18, 2007, the School Board of Hillsborough County approved the Interlocal Agreement for North Mobley Road Improvements with Hillsborough County at Hammond Elementary School. The Agreement stated that both the School Board and the County would join to design and construct roadway improvements on North Mobley Road to improve the vehicular circulation to ensure safer, more efficient traffic conditions during parent drop-off and pick-up periods. The improvements require additional land at the School's northern boundary that abuts the County's existing southern right-of-way on North Mobley Road. The proposed 10,402 +/- square foot dedicated right-of-way, as depicted on "Exhibit A", the Right-of-Way Deed, is for drainage purposes only and no structures will be constructed within this area.

Current title work for the property shows that the site is encumbered by a Memorandum of Ground Lease between the School Board and the Hillsborough School Board Leasing Corporation, which requires the School Board to release the right-of-way portion to complete the transfer, Exhibit "B", the Partial Release.

All documents required for the conveyance, reimbursement of fees and partial release have been reviewed by the School Board Real Estate Attorney and School Board Bond Counsel as to form and sufficiency. Legal fees up to $3,000 incurred by the School Board to finalize this transaction, will be reimbursed by the County, as reflected in Exhibit "C", the Right-of-Way Transfer and Fee Reimbursement Agreement.

Legal expenses estimated at $2,800, incurred by the School Board, will be reimbursed by Hillsborough County for the conveyance of additional right-of-way at Hammond Elementary School on North Mobley Road.
