Elementary "L" and Middle School "SS"
(a) Acceptance of 26.619 Acre Dedicated School Site from Newland Communities
(b) Approval of Utility Easement in Favor of Newland Communities
(c) Approval of Landscape Easement in Favor of Newland Communities
(d) Approval of Temporary Ingress/Egress Easement in Favor of the School Board

EXECUTIVE SUMMARY

In May 2007, the Board approved the Development Order for the Lake Hutto DRI located in the southeastern region of the county. Since that time, staff has been working with the developer, Newland Communities, for the dedication of an elementary and middle school site. The developer will receive impact fee credits equal to the value of the site. This site will contain 26.619 acres and be collocated with a 6+/- acre County park site.

Newland has requested to retain a utility easement and landscape easement within the dedicated site in order to provide the necessary installation, maintenance and repair of the utilities and irrigation system at the dedicated site. Newland will also be responsible for the dedicated school site stormwater retention. The two schools, Elementary "L" and Middle School "SS" are funded and expected to open in August 2009.

Provide adequate school facilities for the accomplishment of all District Goals and Critical Success Factors.

FINANCIAL IMPACT (Budgeted: No)

Impact fee credits in the amount of $1,652,000 will be credited to Newland Communities for this site dedication.
