To provide improved wastewater collection facilities at Grady Elementary School, Hillsborough County Public Schools ("HCPS") has constructed Wastewater Facilities (the "Facilities") in the City of Tampa's Service Area. The plans for the construction of the Facilities were submitted to Tampa's Wastewater Facilities Department and approved as presented. HCPS and the City have mutually agreed that upon completion, it would be economically feasible for the City to accept ownership of the Facilities.

By accepting ownership, the City will be responsible for maintenance and operation and HCPS will guarantee the Facilities against any defects in workmanship and materials for a period of one year as of the date of execution of this Agreement.
