Approve Stipulated Final Judgment and Perpetual Utility Easement Agreement for Underground Sanitary Sewer Transmission Line at First Baptist Church of Dover, Inc. for Strawberry Crest High School, David E. Bailey, Jr. Elementary School and a Future Middle School
EXECUTIVE SUMMARY
As part of the construction of Strawberry Crest High School, David E. Bailey, Jr. Elementary School and a future middle school, approximately four miles of off-site sanitary force main are needed to connect to the Hillsborough County Wastewater Treatment system and provide sanitary sewage service to the three schools.
On November 18, 2008, the School Board approved the Order of Taking of a portion of the Church's property on Martin Luther King, Jr. Boulevard (MLK) and Gallagher Road, known as a "corner clip" to complete the sewer force main crossover section from the south side of MLK. Part of the Board Resolution for Condemnation granted staff permission to continue negotiating a resolution for these easement areas.
On April 21, 2009, the School Board of Hillsborough County approved the price of the Permanent Utility Easement Agreement between the School Board and the First Baptist Church of Dover, Inc. for additional right-of-way. The right-of-way is for a portion of the sewer force main installation to serve all three schools.
The document included in this board item completes both transactions listed above by providing for the payment of fees and costs due to the church in a final stipulated judgment.
