EXECUTIVE SUMMARY
For many years, the standard contracts used by the Facilities Division for design professionals (architects and engineers), construction contractors and construction managers were developed by and purchased from the American Institute of Architects (AIA), with supplemental terms and conditions added to meet the needs of Hillsborough County Public Schools (HCPS). Recently, the AIA contracts were rewritten by the Institute and the previous AIA contract forms used by HCPS are no longer available.
After consultations with other school districts and their attorneys and review of their contracts, contracts for design and construction have been customized for use in the Board's construction management projects. Insurance requirements, provisions for liquidated damages, and other performance requirements have been strengthened to offer greater protections, as suggested by the School Board.
The attached contracts, with minor modifications, will also be used for bid projects and with continuing services contracts. Bid projects costing less than $300,000 will be contracted through the use of a Purchase Order with supplemental terms and conditions.
