Approve Easement Agreement for Ingress, Egress, Operation, Management and Monitoring of Well Site with Tampa Bay Water at Carrollwood Elementary School

Tampa Bay Water (TBW) has requested an easement, consisting of 1,033 +/- square feet, from the School Board for certain monitoring wells located on the eastern boundary of the Carrollwood Elementary School site. These wells are currently on an existing Tampa Electric Company (TECO) easement area and TECO has granted TBW access through their portion. The purpose of this easement is to let TBW inspect, operate, maintain, monitor, repair, replace, upgrade or plug these monitoring wells and their supporting equipment.

School Board staff negotiated a one-time payment of $5,000 for this easement and TBW will also be responsible for the legal fees to Nabors, Giblin & Nickerson, P.A. of $2,500. In order for the School Board to agree to TBW's request, an opinion letter was required under the Certificates of Participation, Series 2006B and 2008A stating that this easement was a permitted encumbrance under the Ground Lease and Lease Agreement relating to these Certificates.

The Easement Agreement has been reviewed by the School Board Attorney as to form and sufficiency.
