Accept the Highest Ranked Proposals Submitted by Various Law Firms - Request For Proposal (RFP) #11115-DST Legal Services for the Department of Risk Management Workers’ Compensation (Business Division)
EXECUTIVE SUMMARY
On September 12, 2011, the Procurement Department, in conjunction with the Safety and Risk Management Office, issued an RFP to establish a contract for legal services for workers’ compensation. Eleven firms responded and a committee of district personnel evaluated their proposals. After presentations and questions, the committee recommended awarding five primary firms and one alternate.

The purpose of this RFP is to establish a pre-approved list of attorneys to provide counsel for the defense of workers’ compensation claims against the district. There is an average of 155 lost time workers’ compensation claims filed yearly, with expenses of approximately $959,000 annually.

The initial term of this contract will be for three years with two one-year renewals. All prices offered are firm against any increase for three years from the effective date. The Superintendent is authorized to approve any extension agreements, per the terms of the specifications.

Legal services for workers' compensation defense expenditures were $940,928 for 2010/2011, and $1,062,912 for 2009/2010.
EVALUATION
Contract administration or evaluation is performed by the Project Manager (end user) and the Procurement Officer, who function as a team.  Reviews are conducted face to face, typically quarterly, or by utilizing an online vendor performance report.  Prior to soliciting a new contract, the Contract Administration team must first give consideration to the specifications and supporting data of the expiring contract.
