Approve Conveyance of Right-of-Way and Temporary Construction Easements to Hillsborough County at Wharton High School and Approve a Partial Release from Certificates of Participation for the Bruce B. Downs Road Widening Project

EXECUTIVE SUMMARY

Hillsborough County has requested to purchase 1,721 square feet of right-of-way and two temporary construction easements from the School Board of Hillsborough County in front of Wharton High School for the widening of Bruce B. Downs Boulevard. 

Wharton High School is also encumbered by Certificates of Participation financing through a Ground Lease Agreement dated April 1, 1994 with The Bank of New York Mellon Trust Company.  In order to convey the additional right-of-way to the County, a Partial Release from the Ground Lease is required.  The attached Partial Release document was prepared by School Board bond counsel and allows the School Board to convey the area necessary for the road widening project.

Hillsborough County will be reimbursing the School Board for the right-of-way, two temporary construction easements and bond counsel legal fees in the amount of $24,400.00

Hillsborough County Board of County Commissioners will reimburse the School Board of Hillsborough County $24,400 for the 1,721 square feet of right-of-way, two temporary construction easements and bond counsel legal fees.
