SUBJECT / RECOMMENDATIONS
Approve Self-Reporting Response to the Securities Exchange Commission Regarding the Municipalities Continuing Disclosure Cooperation (MCDC) Attachments Added
EXECUTIVE SUMMARY
As a follow up to the Municipalities Continuing Disclosure Cooperation (MCDC) initiative and December 1 filing deadline, the attached form will satisfy the requirement of self-disclosure to the Securities Exchange Commission (SEC).

Based upon our review of our historical compliance, the School Board’s annual reports for its fiscal years ended June 30, 2007, and June 30, 2008, didn’t appear on Bloomberg’s website until after the due dates. Bloomberg was a financial reporting website in place prior to 2009 that was used for continuing disclosure documents. The School Board has diligently filed its annual reports and believes that there may have been delays between its filing of the annual reports and their appearance on Bloomberg.  Prior to and subsequent to the filings in question, the School Board’s filings have been timely.  In addition, the School Board retained Digital Assurance Certification (DAC), which is a dissemination agent, in 2009 and with DAC’s assistance, has consistently accelerated the filing of its annual reports as shown on Bloomberg reports.  The annual reports in question appeared on the School Board’s website on December 5, 2007, and December 3, 2008, respectively, both such dates being prior to the due dates of the undertakings.  Further, such reports also appeared on the Federal Clearinghouse website not later than March 31 on an annual basis and were easily accessible for free to anyone from the School Board’s website or the Federal Clearinghouse.  The School Board has historically met other federal filing deadlines such as providing their Comprehensive Annual Financial Reports (CAFRs), to the Federal Clearinghouse no later than March 31 annually.

In an abundance of caution, the School Board is filing the MCDC questionnaire solely due to the Underwriter’s previous reporting of the School Board.
