SUBJECT / RECOMMENDATIONS
Approve the Licensing and Indemnity Agreement Between the Florida Strawberry Festival, Inc. and the School Board of Hillsborough County and Approve the Strawberry Festival Self-Insurance Plan for the School Board's Use of Festival Property by Tomlin Middle and Bryan Elementary Schools
EXECUTIVE SUMMARY

Tomlin Middle and Bryan Elementary Schools are located in close proximity to the property owned by the Florida Strawberry Festival.  The schools have been using the Strawberry Festival's property for student outside activities.

The Strawberry Festival does not charge the School Board a use fee, but has requested that the attached Licensing and Indemnity Agreement be approved by the School Board.  This agreement accepts the Board's sovereign immunity limits of $200,000/$300,000 for indemnity, but they require General and Auto Liability coverage in the amount of $2,000,000 for the times that Adelson Field and the associated parking lot is used by the schools.

The attached Strawberry Festival Self-Insurance Plan in the amount of $2,000,000 meets the insurance requirement and is in compliance with the License and Indemnity Agreement.

FINANCIAL IMPACT (Budgeted:  No)

The Strawberry Festival does not charge the School Board a use fee for Adelson Field and the associated parking lot.  The Strawberry Festival Self-Insurance Plan is an amendment to the School Board's current Self-Insurance Plan, and no additional cost will be incurred.  There have been no claims of any type that have occurred in conjunction with the School Board's use of the Strawberry Festival property.

EVALUATION
Claims are evaluated annually.
