Approve the Proposed Proportionate Share Development Mitigation Agreement for River Bend West, Phase 3 (PI#4675 and School Concurrency #627) (Operations Division) (Revised Attachment, page 5)
EXECUTIVE SUMMARY
In 2008, each of the four local governments in Hillsborough County, in conjunction with the School Board, adopted school concurrency programs.  A school concurrency program is designed to ensure that adequate school facilities are in place or under construction within three years of the impact of new residential development.  The Hillsborough County Public Schools' (HCPS) school concurrency system tracks future residential growth and its impact on school capacity to ensure the District is able to maintain the adopted level of service (LOS). The LOS in Hillsborough County is that schools will not exceed 100% of the Florida Inventory of Schools (FISH) capacity.

If the impact of a new residential development causes a school to exceed the adopted LOS and no adjacent school has capacity to accommodate the projected new students, a proportionate share development mitigation agreement may be entered into by the School District, local jurisdiction, and developer.  This agreement requires the developer to pay to construct the new school capacity needed to meet the LOS in order to move forward with their development proposal.  The agreement includes one phase, which includes 84 single detached units, generating 16 elementary, 10 middle school students, and 12 high school students.

Currently, there is no available capacity at both the elementary and middle school levels within the concurrency service areas serving this site, Ruskin Elementary School attendance boundary and Eisenhower Middle School attendance boundary respectively.  Nor is there capacity in the adjacent concurrency service areas serving this site at both school level. This proportionate share mitigation agreement is needed to allow the residential project to move forward.
STRATEGIC OBJECTIVES
• Establish a strong foundation of financial stewardship • Construct and maintain facilities that create an environment conducive to teaching and learning
FINANCIAL IMPACT (Budgeted:  No)
This agreement will require the developer to pay $692,755.00 to the School District.
