SUBJECT / RECOMMENDATIONS
Approve Apple, Inc., as the Sole Source Provider for Apple Products (Business Services Division)
EXECUTIVE SUMMARY
Hillsborough County Public Schools purchases various Apple products such as iPads, iPad minis, and supplies from Apple, Inc. iPads and other pieces of equipment are purchased districtwide for use including innovative teaching lessons, student one-to-one access, TV production studios, and employee field inspections. These purchases are at various times throughout the year as needed. Apple, Inc., prohibits the sale of Apple products from resellers to public education institutions, and is therefore the sole authorized distributor. In accordance with the Florida Department of Education (FLDOE) Purchasing Policy 6A-1.012(12)(d), commodities or contractual services available only from a single source may be exempted from the competitive solicitation requirements. When a district school board believes that commodities or contractual services are available only from a single source as specified by the FLDOE, the district school board may negotiate on the best terms and conditions with the single source vendor.

FINANCIAL IMPACT (Budgeted:  Yes)
Annual expenditures are estimated to be $350,000 based on historical annual spend. Because these products are ordered districtwide, there is not one specific project number assigned for these purchases.
EVALUATION
Contract administration and evaluation is performed by the Project Manager (the "End User") and the Procurement Officer, who function as a team, by utilizing an online vendor performance report or via in-person reviews. The evaluation consists of an assessment of the vendor-provided goods and services, deliverables, and compliance with contractual requirements. The resulting data will support renewal decisions and/or alterations to a new agreement.
