Approve the Legal Services Agreement Between The School Board of Hillsborough County, Florida and Kubicki Draper (Business Services Division)
EXECUTIVE SUMMARY
This contract is limited to legal services, counsel, consultation, and advice for the Superintendent and staff of Hillsborough County Public Schools on legal matters involving Worker's Compensation services.

This agreement is to remain in full force and effect from June 12, 2019, through June 30, 2020, the “initial term.” Legal services under the agreement may be extended or modified by written agreement. The Superintendent may renew the agreement not to exceed four additional 1-year periods. There is a 30-day termination for convenience clause included in this contract.

Florida Administrative Code 6A-1.012(11)(a) Purchasing Policies states: the requirement for requesting competitive solicitations for commodities or contractual services from three or more sources is hereby waived for: the purchase by district school boards of professional services, which shall include, without limitation, artistic services; academic program reviews; lectures by individuals; auditing services not subject to Section 218.391, F.S.; and legal services, including attorney, paralegal, expert witness, court reporting, appraisal, or mediator services.

FINANCIAL IMPACT (Budgeted:  Yes)
Worker's Compensation costs are expensed from the Self Insurance Fund established each budget year. Expenses for the 2018/2019 fiscal year were $50,400 and included salaries, benefits, health insurance, life insurance, insurance and bond premiums, dues and fees, and claims expense.  Annual expenditures are dependent upon cases each year.
EVALUATION
Contract administration and evaluation is performed by the Project Manager (the "End User") and the Procurement Officer, who function as a team, by utilizing an online vendor performance report or via in-person reviews. The evaluation consists of an assessment of the vendor-provided goods and services, deliverables, and compliance with contractual requirements. The resulting data will support renewal decisions and/or alterations to a new agreement.
