Approve the Revised Proposed Proportionate Share Development Mitigation Agreement for Yarbrough (PI#4774 and School Concurrency #646) Per House Bill 7103 (Operations Division)
EXECUTIVE SUMMARY
In 2008, each of the four local governments in Hillsborough County, in conjunction with the School Board, adopted school concurrency programs.  A school concurrency program is designed to ensure that adequate school facilities are in place or under construction within three years of the impact of new residential development.  The Hillsborough County Public Schools' (HCPS) school concurrency system tracks future residential growth and its impact on school capacity to ensure the District is able to maintain the adopted level of service (LOS). The LOS in Hillsborough County is that schools will not exceed 100% of the Florida Inventory of Schools (FISH) capacity. District and County staff modified the proportionate share mitigation agreement to include changes from House Bill 7103, which modified the proportionate share mitigation impact fee credit statue language from requiring a credit for the “same need” to a “dollar for dollar” credit.  

If the impact of a new residential development causes a school to exceed the adopted LOS and no adjacent school has capacity to accommodate the projected new students, a proportionate share development mitigation agreement may be entered into by the School District, local jurisdiction, and developer.  This agreement requires the developer to pay to construct the new school capacity needed to meet the LOS in order to move forward with their development proposal.  The agreement includes one phase, which includes 74 single detached units, generating 14 elementary, 9 middle school students, and 10 high school students.
  
Currently, there is no available capacity for the middle (9) and for a portion of the high school (8) levels within the concurrency service areas serving this site, Barrington Middle School attendance boundary and Riverview High School attendance boundary respectively.  Nor is there capacity in the adjacent concurrency service areas serving this site at both school level. This proportionate share mitigation agreement is needed to allow the residential project to move forward.

This agreement will require the developer to pay $314,827 to the School District.
