Approve the Revised Proposed Proportionate Share Development Mitigation Agreement for Rhodine Road Subdivision (PI#4343 and #4804 and School Concurrency #555 & #652) Per House Bill 7103 (Operations Division)
EXECUTIVE SUMMARY
In 2008, each of the four local governments in Hillsborough County, in conjunction with the School Board, adopted school concurrency programs.  A school concurrency program is designed to ensure that adequate school facilities are in place or under construction within three years of the impact of new residential development.  The Hillsborough County Public Schools' (HCPS) school concurrency system tracks future residential growth and its impact on school capacity to ensure the District is able to maintain the adopted level of service (LOS). The LOS in Hillsborough County is that schools will not exceed 100% of the Florida Inventory of Schools (FISH) capacity. District and County staff modified the proportionate share mitigation agreement to include changes from House Bill 7103, which modified the proportionate share mitigation impact fee credit statue language from requiring a credit for the “same need” to a “dollar for dollar” credit.  
 
If the impact of a new residential development causes a school to exceed the adopted LOS and no adjacent school has capacity to accommodate the projected new students, a proportionate share development mitigation agreement may be entered into by the School District, local jurisdiction, and developer.  This agreement requires the developer to pay to construct the new school capacity needed to meet the LOS in order to move forward with their development proposal.  The agreement includes two adjacent projects, which are under one ownership.  The first includes 305 single family detached units (previously approved #C555), and the applicant is proposing to add 19 single family detached units (#C555).  The second, adjacent project includes 70 single family detached units (#C652).  This agreement addresses a total net impact of both projects, which includes 89 single family dwelling units generating 17 elementary, 11 middle school students, and 12 high school students.
  
There is currently no available elementary school and high school capacity within the Dawson Elementary School and Riverview High School attendance boundaries (concurrency service area) or in the adjacent concurrency service area, and this proportionate share mitigation agreement is needed to allow the residential projects to move forward.

This agreement will require the developer to pay $863,568 to the School District.
