Approve the Amendment to the Statement of Work for School Year 2019/2020, External Operator for Achievement Schools, Based on the Proposal Submitted by Phalen Leadership Academies (Phalen) - Request for Proposal (RFP) #17146-EST-IV External Operators for Turnaround Schools (Business Services Division)
EXECUTIVE SUMMARY
On March 6, 2018, the board approved the proposal submitted by Phalen for external operator services. Subsequently, on May 7, 2019, the board approved the statement of work with Phalen for the 2019/2020 school year.  This year, Phalen will be working with Foster, Oak Park, McDonald, and Folsom Elementary Schools. If approved, this amendment will revise the terms to include penalty and performance costs that will be applied after school grades come in at the close of the 2019/2020 year.  

The current term of this contract expires June 30, 2020, with one 1-year renewal. There is a 30-day termination for convenience clause included in this contract. This contract will be reviewed and evaluated annually and may be renewed by the Superintendent, per the terms of the specifications.

FINANCIAL IMPACT (Budgeted:  Yes)
The Supplemental Academic Instructional Categorical funds allocated for this fiscal year will be used for the external operator services. The base cost of the contract for all 4 schools will be $1,098,335.37. Dependent upon school grades after the close of the 2019/2020 year, the penalty or performance costs could result in a range of $898,335.37 through $1,698,335.37 total for all 4 schools.
EVALUATION
Contract administration and evaluation is performed by the Project Manager (the "End User") and the Procurement Officer, who function as a team, by utilizing an online vendor performance report or via in-person reviews. The evaluation consists of an assessment of the vendor-provided goods and services, deliverables, and compliance with contractual requirements. The resulting data will support renewal decisions and/or alterations to a new agreement.
