B7.07 - Approve Execution of Fee Simple Deed From The School Board of Hillsborough County, Florida to The Heights Community Development District for a .023 +/- Acre Area at the Southwest Corner Along Palm and Highland Avenues, Tampa for a Roundabout Roadway Improvement at Brewster Technical College (Operations Division)

Description

On November 14, 2017, The School Board of Hillsborough County, Florida, a body corporate, approved a Contract for Purchase and Sale with The Heights Community Development District (the Developer) for a .023+/- acre area at the southwest corner along Palm and Highland Avenues, Tampa, Florida at Brewster Technical College.  The School Board has received payment for the established fair market value of the property and final reimbursement of outstanding legal fees and expenses has been received.  All remediation on School Board property, as stipulated in the work plan, has been completed. 

The Deed expressly states that if the Developer does not convey the area as a roundabout roadway improvement to the City of Tampa in accordance with the adopted Heights Capital Improvement Plan and City of Tampa Master Infrastructure Permit PLN 15-00003, the property will revert back to the School Board.

Gap Analysis

School Board execution of the conveyance deed for the .023+/- acre area located along the southwestern property boundary at Brewster Technical College, completes the School Board's portion of the Purchase and Sale Agreement with the Developer under Florida Statute 1013.28, Disposal of Real Property.

Previous Outcomes

School Board execution of all legal documentation necessary to convey property completes the final step in real property transfer.  The School Board, as one of the largest property owners in Hillsborough County, is an integral part of all our communities and has worked and cooperated with all jurisdictions within Hillsborough County, the City of Tampa and the Department of Transportation.  This jurisdictional cooperation creates a partnership  in roadway and site improvements that enhance our school sites and communities to improve traffic circulation, flow and access.

Expected Outcomes

Upon execution of the conveyance deed to the Developer, the Developer will dedicate the property to the City of Tampa as a roadway improvement, the roundabout, which the City will maintain as part of the proposed Heights Development Community infrastructure.

Financial Impact

Execution of the Fee Simple Deed for .023+/- acres from the School Board to The Heights Community Development District for roundabout roadway improvement will have no financial impact to the School Board.  Fair market value and all expenses have been paid to the School Board by the Developer.
