C12.01 - Development Review Process Research Study (Operations Division)

Description

Over the past year, two major legislative changes occurred to the school concurrency system, which drastically modified the foundational elements.  The first being Senate Bill 7103, which significantly limited the total amount the District could charge developers for their impacts to school infrastructure.  The second, Senate Bill 1066 added an additional layer of impact fee transferability from one project to any other project, so developers are able to sell impact fee credits throughout the County.

These two changes, coupled with the school impact fee increase implemented on June 1, 2020, greatly diminished the value of the school concurrency system. The proportionate share mitigation process is no longer a true school concurrency system due to the systematic revisions to the statutes.  Basically, the system is a pre-payment of impact fees with a required School Board capacity commitment within the Five Year Work Plan.  Therefore, the District has a major construction obligation, but the developers no longer have any additional obligation beyond the impact fee.    

Therefore, the District engaged Tindale Oliver to research what other concurrency or school funding options were available for the District to explore.  The report is attached, but there is no one simple solution identified.  Staff will continue to work with Tindale Oliver and the interlocal agreement stakeholders to develop a better system to provide school infrastructure funding in high growth areas than what is currently being used today.
