SUBJECT / RECOMMENDATIONS

Approve the Contracts with 1) AAG/American Acquisition Group, 2) Absolute Investment and Realty Services, 3) Equis Corporation, 4) Exit Realty Consultants, 5) Florida Acquisition and Appraisal, Inc., and 6) Kilgore Real Estate, Inc. for Request for Proposal (RFP) #4769-TS Real Estate Brokerage Services (Business Division)

EXECUTIVE SUMMARY

On May 2, 2006, the School Board authorized negotiations with real estate brokerage firms recommended by the evaluation committee. The Purchasing Department and the Facilities Division completed negotiations with 1) AAG/American Acquisition Group, 2) Absolute Investment and Realty Services, 3) Equis Corporation, 4) Exit Realty Consultants, 5) Florida Acquisition and Appraisal, Inc., and 6) Kilgore Real Estate, Inc. and the attached contract is presented for your approval. The contract reflects a commission rate and an incentive: 1) for listed property, the final closing purchase agreement for property acquired by the District will reflect the sales price and appropriate incentive commission for property purchased less than the appraisal value, and 2) for unlisted property, the final closing purchase agreement for property acquired by the District will reflect the sales price, a commission rate of three (3) percent and appropriate incentive commission for property purchased less than the appraisal value. If needed, the contract has a clause to allow the District to pay on an hourly rate basis for eminent domain or other specific tasks. The initial term of the contract shall be for a three-year period with an effective date of August 9, 2006. This item has been reviewed by the School Board Attorney.

ANNUAL DISTRICT GOAL(S) AND CRITICAL SUCCESS FACTOR(S)

As stated in OPPAGA report: “Efficient purchasing and warehousing require that management processes be in place to ensure that supplies, equipment, and services vital to the school’s education mission are purchased from a competitive source, in the right quantity, delivered timely to the correct location, and stored in a secure location. These criteria should be met for each purchase without sacrificing quality.”

FINANCIAL IMPACT (Budgeted: Yes)

Funds will be included in the Capital Outlay Budget as outlined on the Capital Outlay Five-Year Plan.

EVALUATION

Contract administration or evaluation is performed by the Project Manager (end user) and Purchasing Agent, who function as a team. Reviews are conducted face to face, typically quarterly, or by utilizing an online vendor performance report. Prior to soliciting a new contract, the Contract Administration team must first give consideration to the specifications and supporting data of the expiring contract.
