APPROVAL OF CONSENT ORDER BETWEEN THE SCHOOL BOARD
AND THE SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT

EXECUTIVE SUMMARY

The School Board, through outside legal counsel, Laurel Lockett, Esquire and the Southwest Florida Water Management District ("SWFWMD") have been working together for several years to negotiate an agreement regarding the placement and permitting of portable structures on school sites. It was determined that in 1999, the School Board had placed portable classrooms or storage buildings at Greco Middle, Miles Elementary and Brandon High Schools that would disrupt the natural stormwater discharge flow at these sites. Due to these disruptions, a review of all portable locations was conducted by the School Board and SWFWMD. In accordance with this study, no corrective actions were necessary on any of the portable classrooms or storage buildings presently sited.

As part of the Consent Order, it is stated that a permit would be required only if the portable facilities were placed in a 100-year flood plain; if a parking lot would be constructed in association with the portable placement; if the alteration of a surface water management system occurred; or if the portable facility is intended to be a permanent structure.

The attached Consent Order has been reviewed by the School Board Attorney as to form and sufficiency.

Goal 6 - All schools in the district will be assigned a state grade of A, B, or C.
