APPROVE DEVELOPMENT ORDER LAKE HUTTO DRI

EXECUTIVE SUMMARY

On December 5, 2006, the Board of County Commissioners (BOCC) approved a new community called Lake Hutto, a Development of Regional Impact (DRI). Lake Hutto is located in the southeastern part of the County (Fishhawk Area--see attached map). Under the terms of the development order approved by the BOCC as part of the DRI, the developer, Pulte Home Corp., is required to dedicate to the School District 26 acres for a middle and elementary school to be collocated with a 6 acre park. In addition, Pulte is required to pay $3 million for a classroom addition at Newsome High School.

The $3 million is to be paid in three installments. The first $500,000 payment is due 30 days after the effective date of the development order. The approval of the Lake Hutto project was challenged through an administrative process delaying the "final" aspect of the development order. The challenge has since been settled and the expiratory period for further challenges has passed. The first payment of $500,000 is scheduled to be made on May 27, 2007. The second payment of $1 million is due when the addition commences construction (anticipated to be in August 2007) and the third payment of $1.5 million is due when the certificate of occupancy is issued for the addition (approximately August 2008).

The dedication of the two school sites is underway and will be brought back to the School Board after all the necessary documentation has been received. The two schools, Elementary "L" and Middle School "SS" are funded and expected to open in August 2009.

Provide adequate school facilities for the accomplishment of all District Goals and Critical Success Factors.

FINANCIAL IMPACT (Budgeted: Yes)

$3 million to be paid to the School District to be used toward a 600 student station addition at Newsome High School. Land dedication of 26 acres for a middle and elementary school to be collocated with a 6 acre park.
