Approve Temporary Access, Sidewalk and Utility Easement Agreement with Hillsborough County at Turner Elementary and Bartels Middle School Campus

EXECUTIVE SUMMARY

To accommodate capacity needs necessitated by the Class Size Reduction Amendment and growth, beginning in the 2010-2011 school year, 5th grade students from Turner Elementary School will be housed in vacant classrooms at the adjacent Bartels Middle School. To keep the students connected to Turner, a six foot wide sidewalk will be constructed to join the two schools and communication cable will be installed and buried beneath the ground. These improvements will traverse through Live Oak Park which is owned by Hillsborough County. School Board and County staffs have worked together to develop the documents needed for the School Board to obtain a temporary access easement over and under the County property. County Real Estate will be requesting the approval of the temporary easement at the Board of County Commissioners' August 4, 2010 meeting.

After the project is completed, Hillsborough County will grant a permanent easement to the School Board with the condition that it will not hinder the County's use of the area for drainage purposes and that the County will not be responsible for the maintenance or repair of these improvements.

FINANCIAL IMPACT (Budgeted: No)

Approval of the temporary access, sidewalk and utility easement from Hillsborough County will have no financial impact to the School Board. The funds for the construction of the improvements to the Turner Elementary and Bartels Middle School campus will be derived from Local Millage.
