Approve Use of Facilities Agreement with Fusion Futbol Club of Tampa Bay, New Tampa Patriots Football and New Tampa Lacrosse Association, Inc. at Benito Middle School

EXECUTIVE SUMMARY

In August 2001, the School Board, The City of Tampa and the New Tampa Soccer Association (now known as Fusion Futbol Club of Tampa Bay) were parties to an Agreement for use and maintenance of the fields located at Benito Middle School. The City has opted not to renew the Agreement, but the School and the Soccer Club are working together to continue the Club's use of the fields. Two other sports leagues are also seeking permission to use the fields at Benito. Those leagues are New Tampa Patriots Football and New Tampa Lacrosse Association, Inc. Because it is beneficial to the children who participate in the leagues and teams, it is recommended that all three leagues be permitted to continue to use Benito's fields. District staff has worked with the leagues to establish a calendar to schedule use as outlined in the Agreement.

This Agreement for the Use of School Facilities between the School Board and the three leagues will be for the fields identified on Exhibit A. The leagues may also have use of the school's paved parking area when not being used by the school. All three leagues will be responsible for the maintenance of these fields, including the cost of water for irrigation, where it exists, and for electricity for the lighting. The City of Tampa has granted all three leagues permission to use the restroom facilities in the City operated recreation building on site. The term of this Agreement shall be for one year with two one-year renewal options. No fees will be charged to the leagues for the use of the fields.

The cost of maintaining the fields at Benito, including the cost of water for irrigation and cost of electricity for lighting, will be the responsibility of the three leagues.
