Approve the Restatement of Restrictive Covenants for Mitchell Elementary School

EXECUTIVE SUMMARY

As part of the renovation project at Mitchell Elementary School, grant funding in the amount of $302,990 was awarded to restore certain parts of the historic structure back to original condition. On July 21, 2005, restrictive covenants were recorded against the title ownership of Mitchell Elementary School. These covenants designated the School Board as a grant recipient by the State of Florida, Division of Historical Resources, and inadvertently incorporated legal descriptions for school sites in addition to Mitchell Elementary. Therefore, these covenants need to be restated and corrected. By approval and proper recording with the Clerk of the Court, these covenants will only adhere to Mitchell Elementary and not encumber title to any other school sites.

Provide adequate school facilities for the accomplishment of all District Goals and Critical Success Factors.

FINANCIAL IMPACT (Budgeted: No)

Grant funds in the amount of $302,990 have been awarded by the Department of State, Division of Historical Resources. There is no cost to the District by approval of this item.
