Approve Amended Hold Harmless Agreement Memorandum of Understanding Regarding the Agricultural Lease with Artesian Farms, Inc. for Cattle Pasture for Agribusiness Department, Lennard High School, 2008-2009

EXECUTIVE SUMMARY

On August 5, 2008, the School Board approved the Agricultural Lease with Artesian Farms, Inc. for use of land by the Lennard High School Agribusiness Department beginning on September 1, 2008. The Agribusiness Department manages cattle that are used for land laboratory experiences for students enrolled in the Veterinary Assisting and Agritechnology Programs. The Hold Harmless Agreement (Exhibit "A") has been amended to address concerns of the School Board Attorney and the item is being brought back to the Board for approval.

There is no cost associated with the lease for the land/pasture use and the Lease is renewable for up to two additional years. As part of the Lease, the School Board agrees to indemnify and hold harmless Artesian Farms, Inc., its agents and employees, against liability for personal injury arising from the negligence of the School Board, or the negligence of the School Board's agents or employees. The wording on the attached amended Hold Harmless Agreement incorporates the language and insurance provisions currently approved by the School Board Attorney.

Provide adequate school facilities for the accomplishment of all District Goals and Critical Success Factors.

FINANCIAL IMPACT (Budgeted: Yes)

The land laboratory is an integral part of the Veterinary Assisting program and is funded through the general operating budget.
