Grant Bid Protest for Bid #0008229 Fuel Station Upgrades
EXECUTIVE SUMMARY
The Superintendent recommends that the Board grant the protest of MDM Services, Inc. in the referenced bid. MDM was the apparent third lowest responsible bidder for the work encompassed within the bid. MDM timely filed a notice of protest within seventy-two hours and thereafter filed a timely formal protest. Pursuant to the law applicable to such situations, Facilities Division met with the protester in an attempt to amicably resolve the protest. MDM protested the failure of the first and second apparent low bidders to include information relating to subcontractors which was required by the bid documents. The required information was in fact not supplied and therefore the Superintendent recommends that the protest be granted. The work bid involves a unique situation which made the omission of required information understandable if not acceptable. For this reason, as well as because the difference in bid amounts is substantial and for the best interests of HCPS, the Superintendent recommends that the work be re-bid.
The School Board attorney recommends approval of the Superintendent's recommendation.

FINANCIAL IMPACT (Budgeted: Yes)
Because the matter will be competitively bid, it is not anticipated that there will be any additional costs. There may be savings from the new bid dependent on participation.
