Approve Resolution Authorizing the Taking by Eminent Domain of Parcels of Property Necessary to Construct Roadway, Sidewalks and Signalization which Hillsborough County has Required the Board to Provide in Connection with the Construction of Strawberry Crest High School, David E. Bailey, Jr. Elementary School, and a Future Middle School
EXECUTIVE SUMMARY
In connection with the construction of Strawberry Crest High School, David E. Bailey, Jr. Elementary School and a future middle school, Hillsborough County required the Board to provide certain infrastructure, including sanitary sewers, roadways, sidewalks and signalization. Board staff has been able to acquire almost all of the lands necessary to meet this obligation, but the owners of two parcels have not agreed to sell their property. The Board is authorized by law to exercise the power of eminent domain to acquired lands needed for educational and related purposes. Before it exercises this authority, the Board is required to adopt a resolution setting forth the purposes for which the properties are to be taken and directing staff to file the action, including the direction that the properties be taken before final judgment is needed, with the compensation to be determined by agreement or court order thereafter. The two parcels of land to be taken have been valued by Board retained appraisers at $28,019.00 and $8,160.00 respectively.
