Approve Joint Use Agreement Between The City of Tampa and The School Board For Use of The Tampa Park Plaza Playground Adjacent to Booker T. Washington Elementary School

On January 27, 2009, the School Board approved an Interlocal Agreement for the joint use of the Tampa Park Plaza Playground adjacent to Booker T. Washington Elementary School and submitted the agreement for City of Tampa Council approval. Subsequently, the City requested language changes in order to clarify specific maintenance and access issues. The attached Joint Use Agreement includes detailed construction, functionality, maintenance, funding and access language as suggested by the City Attorney and reviewed by the School Board Attorney as to form and substance.

The School Board funded the cost of design and installation of the fencing and will be responsible for the maintenance of same; the City of Tampa will be responsible for the maintenance of the grounds enclosed by the School Board's fencing. Tampa's maintenance personnel will coordinate with B.T. Washington's Principal for access to conduct the ground maintenance if during school hours. The Park will remain a public facility during non-school hours and be used by the school during regular school hours and summer sessions.

The cost of design and installation of the fencing surrounding the Tampa Park Plaza Playground in the amount of $12,500.00 will be derived from Local Millage Capital Outlay. The City of Tampa will be responsible for maintenance of the grounds through its maintenance funds.
