Approve Fifth Amendment to Primary User Agreement with University Area Community Development Corporation, Inc., Three-Year Extension to User Agreement

EXECUTIVE SUMMARY

We request approval of the Fifth Amendment to the Primary User Agreement with University Area Community Development Corporation, Inc. to lease facility space at the University Area Community Center for adult and community education classes. Since 1999 the District has leased 7 spaces at the Center; 3 classrooms, 2 labs, 1 nursery and 1 nursery bathroom, totaling just under 4,000 sq. ft.

The programs offered at this site include Adult Basic Education (ABE), General Education Development (GED), English for Speakers of Other Languages (ESOL) and Family Literacy classes. The University Center has the facilities to service both the adult programs and the services for the young children in the family programs. 

The Fifth Amendment provides a three-year extension from  July 1, 2011 - June 30, 2012 at an annual rate of $129,781; and July 1, 2012 - June 30, 2013 rate of $133,674 annually; and July 1, 2013 - June 30, 2014 a rate of $137,684 annually.  These charges include utilities, security and custodial services.  The new lease reflects a 10% decrease from the current rate ($144,201) for the first year of the agreement.  Each subsequent year the lease rate increases by 3% per year.

FINANCIAL IMPACT (Budgeted:  Yes)

Rental expenses of $129,781 for the 2011/12 fiscal year are included in the divisional workforce education budget. Funds for the 2012/13 and 2013/14 fiscal years, $133,674 and $137,684 respectively, will be budgeted in the divisional workforce education budget.  Termination provisions are included in Primary User Agreement, (Attachment A, Section 20, Page 19), that allow cancellation of the lease if workforce funding is no longer available.
