Approve Conveyance of Additional Rights-of-Way to Hillsborough County at Mulrennan Middle School

Hillsborough County has requested additional rights-of-way from the School Board at Mulrennan Middle School.  The first area will be for a signalization project and the second as part of the County's continuing School Safety & Circulation Access Program.   Attached are two Fee Simple Deeds to convey a small portion of the northwest boundary of the school at the intersection of Durant and Pearson Roads for signalization and approximately 2,668 +/- square feet at the school's southwestern boundary on Durant Road.  The conveyance of the Durant Road portion was already encumbered by an easement to Tampa Bay Water.  Hillsborough County entered in a Mutual Use Agreement with Tampa Bay Water to use this area as evidenced by the attached Mutual Use Agreement.

Mulrennan Middle School is also encumbered by Certificates of Participation financing through a Ground Lease Agreement dated October 1, 1999 with The Bank of New York Mellon Trust Company.  In order to convey the additional rights-of-way to the County, a Partial Release from the Ground Lease is required.  The attached Partial Release document was prepared by School Board bond counsel and allows the School Board to convey the area necessary for the roadway improvements.  Hillsborough County will be responsible for up to $2,600 for the legal fees and document recording for the Partial Release.

Approval of the conveyance for additional rights-of-way from the School Board of Hillsborough County to Hillsborough County for access improvements and signalization at Mulrennan Middle School will have no financial impact to the School Board.  Legal fees up to $2,600 incurred for document preparation and recording for the Partial Release of the Ground Lease Agreement between the School Board and The Bank of New York Mellon will be borne by Hillsborough County.
