Lacrosse Contract
EXECUTIVE SUMMARY
In response to the Board’s direction, the School Board attorney has discussed with HALAX the proposed lacrosse agreement and the attached represents the terms and agreements to which HALAX has agreed.  The Superintendent’s recommendation will be provided separately.  The School Board attorney does not submit a recommendation, except as to form and legality, since the Board has not yet voted on the express terms of the agreement.

The agreement contains those terms to which HALAX has agreed.  The differences between the agreement and the administration’s last proposal are shown on the attached “red-line” version of the document.  The clean copy of the agreement, executed by HALAX is also attached.  The provisions of the agreement include the following: 

1.  The agreement provides for a start of interscholastic play in January of 2014 (in the 2013/14 school year).  In the current school year, lacrosse will continue to be a club sport.  HALAX would have access to schools to promote the sport and HALAX would seek to establish clubs at Tampa Bay Tech and Jefferson in the current year, with players being encouraged to play on established clubs if there is not enough interest at TBT and JHS (or Title IX participation rates are not met) to form clubs at those schools, in order to allow for the development of interest and allow first time players to obtain playing experience. 

2.  Practice fields would be provided at TBT and JHS and at other high schools, if space is available.  If space is not available, practice fields would be provided at a feeder school.  

3.  HALAX will be responsible for supplying the items, and for the costs, described in the agreement (in the amount stated in the agreement) and for other costs “not covered.”   The School Board would provide custodial services for game, an administrator for the games and utilities.  In the event that the amounts stated for various costs are not sufficient to pay for actual out-of-pocket expenses, HALAX will pay those additional amounts. 

4.  The season will be for 13 games, with games to take place on a weeknight and Saturday mornings.

 5.  The term of the agreement is three years, subject to termination without cause by either party.
