Approve New Fingerprinting Fees and Recommended Changes from Previously Approved, August 21, 2007, Jessica Lunsford Act (JLA) Guidelines.
EXECUTIVE SUMMARY

Effective July 1, 2013, House Bill 21, regarding the background screening of non-instructional contractors, provides allowable changes for districts to consider.  Our district will not allow the "in-line of site" (ex: a company has one employee with a state badge supervising the other employees from the same company who have not been fingerprinted or have a JLA badge), but will continue to use the "six-foot fence rule" presently in place (ex: a six-foot fence encloses the entire construction project and is separate from students and employees).  In addition, we will continue to require contractors and vendors to register with our district and obtain our current "yellow" JLA badge, along with the newly designed state badge that districts are required to qualify and create for approved vendors and contractors.  We currently charge a $4.75 administration fee, but do not charge for the badges. 

The Technical Assistance Paper from DOE regarding HB21 allows districts to charge a fee for the state badge not to exceed $10.  The district is requesting to add the $10 state badge fee to the present $4.75 administration fee in order to provide the necessary funds to create the state badge, as well as support the equipment related to producing the badge and maintaining the equipment, service contracts, and required upgrades. A copy of the DOE Technical Assistance Paper is attached -- information pertaining to the state badge is located on Page 6 - Section V (Questions and Answers).

Effective August 14, 2013, contractors and vendors will be required to hold the state badge in order to have access to our facilities.  The cost of the badge will be $10 and will be the responsibility of the individual contractor/vendor.  No changes have been made to the current fingerprinting fees, which are $78.50.  Contractors will be responsible for the $78.50 for FBI/FDLE screening and the retention/monitoring fee every five years.  Districts are allowed to charge up to 30 percent ($19.35) above the fingerprinting fee and, in addition, charge up to $10 for the state badge.  In summary, contractors/vendors will be required to pay the already School Board approved fee of $4.75 and the new $10 state badge fee, in addition to the fingerprinting fee of $78.50.  The total amount will be $93.25 ($78.50 for DOE required fingerprinting fees, plus $14.75 for administrative fee and state badge).
