Approve Settlement Agreement for Kid’s Community College and Kid’s Community College Middle Charter School
EXECUTIVE SUMMARY
During the 2012-2013 school year, Kid’s Community College and Kid’s Community College Middle Charter School participated in a contract renewal review as required in state statute. Several deficiencies were noted during the review. The school was given an opportunity to address the deficiencies. Adequate corrections were not made, and on April 30, 2013 the Superintendent issued a 90 day letter to terminate the contracts. The District and the Schools continued to engage in discussions about the existence of and corrections of those deficiencies.

 On July 2, 2013, the Superintendent withdrew the notice of termination and informed the Schools that the District would continue to monitor the deficient areas noted in the review of the Schools. The process of negotiating the charter contract began but agreement was not reached in the term of the contract.

The Schools pursued mediation but this process ended in an impasse.

On December 18, 2013, the Schools filed a Notice/Request for Initiation of Proceedings to the Administrative Law Judge pursuant to F.S. 1002.33(6)(h). Hearings regarding the case were held on several separate dates and a final hearing date was scheduled for July 21, 2015.

On July 13, 2015, the Superintendent met with the school leadership and an agreement was made to end the litigation and move forward with the negotiation of a ten year consolidated contract.

On July 20, 2015, an Order Closing the File was filed and a settlement agreement was drafted.

Attached is the Settlement Agreement that has been agreed to by the District and Kid's Community College and Kid's Community College Middle Charter School

The cost of the litigation of the contract for Kid’s Community College and Kid’s community College Middle Charter School including this settlement agreement was approximately $50,000.
